1. INTRODUCTION

These Terms & Conditions apply to all orders placed through the online store and to the use of the website operated by The Guide Artists.

By placing an order or using the website, the user agrees to these Terms & Conditions.

If the user does not agree, they must refrain from using the website.

The presentation of products in the online store does not constitute a legally binding offer, but a non-binding online catalogue.

After placing an order, the customer will receive an automatic order confirmation email. This confirmation does not constitute acceptance of the order.

Acceptance of the order occurs only when the customer receives a shipping confirmation email including tracking information.

In the case of advance payment, acceptance may occur at the time of order confirmation depending on the payment method.

3. PRICES, CONDITIONS AND SHIPPING COSTS

All prices are displayed in euros (€) unless otherwise stated.

Shipping costs may be added during checkout and will be clearly indicated before completing the order.

For international shipments, the customer is responsible for any additional customs duties, import taxes, or local charges that may apply in the destination country.

3.1 DELIVERY CONDITIONS

Orders are delivered with a signature requirement upon receipt.

Risk of loss or damage is transferred to the customer upon delivery.

4. PAYMENT

The following payment methods may be available:

Payments may be processed through PayPal.

PayPal may also allow payment via credit or debit cards depending on availability in the customer’s country.

4.2 PRE-ORDERS

Pre-orders allow customers to reserve products before their official release or production completion.

Key conditions:

  • Estimated delivery times are indicated on the product page and may change

  • Delivery may occur earlier or later than estimated, with possible delays of up to one month

  • Payment is charged at the time the pre-order is placed (unless otherwise stated)

  • Pre-ordered items are shipped once available

4.3 ON-DEMAND AND LIMITED PRODUCTS

Certain items may be:

  • Printed on demand if out of stock

  • Limited editions or collector’s editions

Print-on-demand production time is typically 10 to 15 working days from order confirmation.

Limited editions are subject to availability and may not be restocked.

5. OWNERSHIP OF GOODS (RETENTION OF TITLE)

All products remain the property of The Guide Artists until full payment has been received.

6. SHIPPING AND DELIVERY ISSUES

6.1 Shipping Damage

If a product arrives damaged:

  • The customer must report the issue as soon as possible

  • Photographic evidence of packaging and product damage must be provided

  • The customer must contact customer service immediately

Failure to notify the carrier or The Guide Artists does not affect statutory consumer rights but may limit the ability to claim compensation from the carrier.

Where applicable, replacement or refund will be arranged.

6.2 Printing or Production Errors

In case of printing defects or binding issues:

  • The customer must contact customer service immediately

  • Photographs of the defect must be provided

A replacement copy will be sent if stock is available or as soon as production allows.

7. RETURNS, REFUNDS AND GUARANTEE

If a product is defective or not in conformity, the customer may be entitled to a refund or replacement in accordance with applicable consumer law.

Refunds will cover the value of the product.

Original shipping costs may not be refunded unless required by law.

9. LIABILITY

The Guide Artists’ liability is limited to the value of the purchased product, except in cases of:

  • Personal injury

  • Health damage

  • Death caused by negligence

The Guide Artists is not liable for minor breaches of contractual obligations or indirect damages.

10. ONLINE DISPUTE RESOLUTION

In accordance with Article 14(1) of Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform:

The Guide Artists is not obliged and does not commit to participate in consumer arbitration proceedings.

11. MINORS

Products offered through the online store are intended only for users over 18 years of age.

Minors may only use the website under the supervision of a parent or legal guardian.

12. INTELLECTUAL PROPERTY

All content on the website, including products, designs, images, texts, and editorial materials, is protected by intellectual property rights.

No content may be reproduced, distributed, or used without prior written authorization.

13. FINAL PROVISIONS

If any provision of these Terms & Conditions is found to be invalid, the remaining provisions shall remain in force.

The Guide Artists reserves the right to modify these Terms & Conditions at any time.

14. APPLICABLE LAW AND JURISDICTION

These Terms & Conditions are governed by Spanish law.

Any disputes shall be submitted to the courts of Cádiz, Spain, unless mandatory consumer law provides otherwise.
